DIVORCE (continued from p. 5)
If You Receive Notice from the Court That You Are Being Sued for Divorce
If you receive a notice from the court that your husband has filed suit for a divorce, you will have 28 days in which to tell the court what you want to do. You have two choices:
1. You can contest the divorce by filing a paper called an ANSWER. There are two basic reasons for contesting a divorce. One reason is that you do not want a divorce at all. The second reason is that you want to be sure to have a say in the terms of the divorce.
The immediate effect of filing an answer will be that the court will hold up the divorce for a while, usually from six to eight months. This is to give the parties time to work out an agreement between themselves.
2. You can let the divorce go uncontested by filing nothing with the court. If no answer is received, the court will set the case for a hearing without you in a few months.
If you agree to getting a divorce, you should try to come to an agreement with your husband as to the form and the terms of the divorce. They will greatly affect your lives; and you can maintain the most control over them by agreeing between yourselves. This can also help you to avoid some of the bad feelings that can arise in a divorce. Read the sections on "Ways to End a Marriage" (see WSW, September, 1978), and "Dividing Up the Marriage" (to be published in the November, 1978 issue of WSW). This information applies to you whether you are suing for or being sued for divorce.
It is important that you protect yourself when being sued for divorce. Whether or not you want to
hire a lawyer, it would probably be best to at least talk with one about your case. If you cannot afford to hire a lawyer, you can sometimes have his/her fees paid by your husband as part of your alimony. If your husband has a lawyer, it is especially important that you have a lawyer to protect your interests.
It is also important that you take some steps on your own to protect yourself during the divorce. See the steps suggested in "Preparing for Divorce" in the September, 1978 issue of WSW.
If you do not know where your husband is
1. You or your lawyer must ask the court to place the notice in the local legal newspaper. In Cuyahoga County this is the Daily Legal News. This is called service by publication.
2. This notice states that the divorce has been filed, the date filed, the number of children, the date by which the husband must answer, and the date of the hearing.
8. The notice must run in the paper once a week for six weeks.
4. This kind of notice costs about $55.00 extra.
5. If service is by publication, the court can grant the divorce and decide custody, but cannot order support for you or for the children.
Once the six weeks of publication are up, the court will wait 28 days for your husband to answer.
Waiver of service of summons
If your husband already knows about the divorce. he can sign a paper saying so. this is called waiver of service of summons. To waive service of summons a person must be over 18 years of age.
